The Welsh Government is currently consulting on Proposed Changes to Non-Domestic Permitted Development Rights.
The Welsh Government, as part of its commitment to improve the planning application process and to support economic recovery, is consulting on a number of changes to the non-domestic permitted development rights set out in the Town and Country Planning Order 1995.
Whilst there are a number of proposed changes to the permitted development rights outlined in the consultation, the main changes which would have implications for the agricultural sector are outlined in section 3A and include -
Allowing new buildings upto 100m2 to be constructed
Replacing references to cubic content as a measure of the maximum volume of permitted development with height and distance measurements
Amendments to the maximum floor area for an extension to an existing building
Clarification of the rules which cover the impact on the external appearance of a premises if an existing building is altered or extended
Section 3H also has implications. To bring Wales in line with England, it is proposed to amend the definition of article 1(5) land to include World Heritage Sites in addition to National Parks, Areas of Outstanding Natural Beauty and conservation areas to protect these sites from any cumulative impacts from developments.
